Patent

On September 21, 2011, the Dual Fluid Reactor concept was submitted to the German Patent Office. Since then, protection of priority holds, granting all rights of use to the patent owners. The protection is only finalized, though, after a sufficient level of ingenuity and novelty has been identified by the patent office. This is decided by each nation’s patent office individualy.

Fees for examination as well as for registration plus yearly fees have to be carried by the applicant. Costs for patent attorneys — which may include representatives in the respective country — and for translations may come in additionally. Thus, it is advisable to check carefully for which nations an application makes sense. In Canada, we dropped our application due to high costs.

The patent application is currently pending in these countries or federation of countries:

• Europe
• USA
• Japan
• Russia
• Korea
• India

In 2017, patent was granted in Europe and Russia and in 2018 in Japan: It was decided that the application is in fact an invention and thus warrants full protection. In the other nations listed, patent is still pending.

Only the examination is centralized in Europe, a patent granted must be registered in every nation individually afterwards, which may cause massive additional costs. Among the 38 countries, we selected the following: FR, GB, CH, DE, AT, PL, SE, FI, BE, LI, LU, CZ, NO, NL, SK, LT und HU.

Der Zustands eine Patentantrags kann oft in den Datenbanken des jeweiligen nationalen Patentamts abgefragt werden. In den Ansprüchen können dabei, während das Prüfungsverfahren läuft, noch Änderungen auftreten. Der letzte Stand der internationalen Anmeldung ist hier zu finden. Unter “National Phase” sind dort einige Länder aufgeführt, die Liste ist jedoch nicht vollständig, da nicht alle Ämter der WIPO zuarbeiten. Ausführlicher ist hier die Datenbank des Europäischen Patentamts, Espacenet. Der Eintrag zum DFR listet unter “Also published as” bis auf Indien alle betroffenen Länder auf.
